Neil Garfinkel Warns Renters of Refer-A-Friend Incentives.
Neil Garfinkel, the partner in charge of the firm’s Real Estate and Banking practices, spoke to Brick Underground about the pitfalls of refer-a-friend rent credit programs offered by landlords. He said that prospective renters who actively solicit others so they can get rent credits, even on social media, can find themselves in trouble because it could be seen as operating a business.
Mr. Garfinkel added that this can be considered real estate activity, and if the renter does not have a real estate license, they may face criminal charges. “It can get into a gray area very quickly,” he said.
